By booking a tour, hire, or charter (the "Event") with MI Ride Discovery Tours or MI Ride Bus Charters ("MI Ride"), you agree to the following terms and conditions on behalf of yourself and all participants in your booking.
 

1. Risk Acknowledgment & Liability Release

• Assumption of Risk: You acknowledge that participating in tours and transport on Magnetic Island involves inherent risks, including rugged terrain, weather extremes, physical exertion, and remoteness from medical services. Participation is entirely at your own risk.

• Release & Indemnity: To the maximum extent permitted by Australian law, you release and hold harmless MI Ride, its directors, employees, and agents from any claims, suits, or liabilities arising from or connected to your participation in the Event.

• Safety & Conduct: You agree to follow all safety instructions, rules, and reasonable directives issued by MI Ride staff during the Event.

 

2. Fitness to Participate & Medical Consent

• Health Declaration: You confirm that you are medically and physically fit to participate. If your medical condition changes prior to or during the tour, you must notify MI Ride immediately.   

• Medical & Emergency Treatment: In the event of injury or illness, you consent to receiving necessary first aid, rescue assistance, or medical treatment arranged by MI Ride. You agree to reimburse MI Ride for any out-of-pocket costs incurred for emergency care or evacuation.

3. Media & Promotional Use

You consent to MI Ride taking photos or video footage during the tour/charter and using these materials for marketing, promotional, and social media purposes without financial compensation. 

4. Cancellation & Refund Policy - Individual Tour Bookings (Tours)

Please do not attend if you are unwell. Contact us as soon as possible, and we will offer to reschedule your tour or issue a full refund.

If You Cancel:

• 24 hours or less (or No-Show): 100% cancellation fee (no refund).

• 24 to 48 hours notice: 20% cancellation fee (if seats cannot be resold).

• More than 48 hours notice: Full refund.

 

If We Cancel: If MI Ride cancels due to weather conditions or unforeseen circumstances, you will receive a full refund or the option to reschedule.

Private Hire & Bus Charters

If You Cancel:

• Less than 48 hours notice (or No-Show): 100% cancellation fee.◦   

• 2 to 5 days notice: 30% cancellation fee.  

• 5 to 7 days notice: 15% cancellation fee. 

• More than 7 days notice: Full refund.

 

If We Cancel: Full refund or reschedule offered if cancelled due to severe weather or operational reasons.

5. Privacy Summary

• MI Ride collects and handles your personal information (such as name, contact details, payment info, and booking preferences) in accordance with the Privacy Act 1988 (Cth).

• We use your details solely to process your bookings, ensure tour safety, communicate essential updates, and manage customer service.
